This may be legal in the u.S., but in Quebec, there is a comprehensive and
direct criminal law:
“Theft of signal is a theft, like any other theft.”
This makes no distinction of how the theft was done, or what was stolen,
misappropriated, etc.
That is enough to get a person a criminal record, notwithstanding any other
penalties.
also, on a residential internet servie agreement, it is illegal to share
the service. (In Canada, telecommunications services are heavily taxed and
ISPs are obliged to be the tax collectors.)
Canadian ISPs that may be subsidiaries of American companies are all
separate companies and they must operate by Canadian Laws, including
collecting the same taxes.
However, and notwithstanding any intellectual property rights, data that
has been downloaded is data, and I have not heard of any litigation going
after that.
